The federal justice of Brazil ordered to revoke the preventive detention of Germán Naranjo, the Chilean engineer who had been in Guarulhos prison since May 15, accused of endangering air transport safety and <buttering racist and homophobic insults, among other charges.
The judge Fabiana Alves Rodrigues issued the resolution after accepting the request of Naranjo’s defense, lawyer Carlos Kauffmann, and issued the release document under precautionary measures.
“I accept the defense’s request and replace the preventive detention of Germán Andrés Naranjo Maldini with the following precautionary measures”, stated the magistrate in her judicial pronouncement.
Then detailing them: “prohibition to leave the country, with continuous retention of his passport (…). Electronic monitoring, with establishment of a circulation zone in the metropolitan region of São Paulo.”
The judicial ruling also established that Naranjo must present himself at the secretariat of the judicial headquarters on the first business day after his release from the penal facility to sign the periodic appearance record, along with appearing at all acts of the criminal process when summoned and receiving summonses via WhatsApp.
In addition, the measure requires the Chilean to keep the court informed of any change of address, phone, or email.
Last June, the Federal Public Ministry (MPF) of Brazil filed five charges against Naranjo, after the executive was arrested at Guarulhos airport on May 15 upon his return from Germany.
This followed an incident during the outbound flight of the Latam airline – covering the São Paulo-Frankfurt route – where the Chilean assaulted crew members. Since that day, he had been in preventive detention.
According to the Brazilian Prosecutor’s Office, the former executive of the fishing company Landes, besides the crimes of endangering air transport safety and racist insults to airline employees, also had to answer for threats directed at Federal Police agents who approached him, along with disobedience and resistance to authority.
The first of these incidents occurred in the early hours of May 11, during the flight to Frankfurt, Germany, when he attempted to force one of the emergency exits.
At that moment, after being restrained by the crew, he addressed one of the employees, calling him “gay” in a derogatory tone and “monkey”. He also made offensive comments about the skin color of a team member and stated that he “smelled like a Brazilian.”
The episode was recorded and sent to the Federal Police, and later the Court issued the preventive detention order, which was executed on the 15th, when the engineer disembarked again in Guarulhos.
When he was approached by police officers in the Latam VIP lounge at the airport, he resisted arrest and uttered insults to the agents, who had to handcuff him.
